I am the owner of [Personal Information Redacted], Seven Mills, Clonburris. In addition to the purchase of my home, a parking space on the street in a home zone was allocated to my property under an exclusive use agreement. Other paid extra for street parking allocation to individual dwellings. I own an electric vehicle and rely on this space given the lack of access to the cycle path over the canal to cycle, no bus routes and no space in the train carriage due to the postponed Dart+ south west.

I object to the wording "Management to ensure on street spaces are not allocated to individuals" unless it is clarified. I request that the Planning Scheme expressly state:

  1. This provision applies only to new planning applications made after the amendment is adopted. It must not apply retrospectively.
  2. It does not affect, cancel or override any existing exclusive use agreement or parking allocation made to an individual home, including on-street spaces in home zones.
  3. Existing allocations remain protected when estate roads are taken in charge by the Council.
  4. Nothing in this amendment affects the legal rights of homeowners who purchased in reliance on these agreements, including their rights against the developer or vendor.
  5. Any future reduction in parking provision is linked to the delivery of DART+ South West, and only takes effect once that service is fully operational.

Homeowners bought their properties relying on these allocations. Removing them retrospectively would be legal and would cause disputes and loss of property value/ legal action against the developer.
